ILLEGALLY CONSTRUCTED SWETAMBAR JAIN
TEMPLE TO BE RAZED IN MUMBAI
The
Bombay High Court has asked the Mumbai Municipal Corporation to demolish an
illegal Jain temple in Jagdusha Nagar, Ghatkopar (east), in eight weeks.
Following a public interest litigation filed by a resident, Satish Bane, the
division bench of acting Chief Justice A. P. Shah and Justice S.U. Kamdar
reprimanded the BMC for not taking any action against the illegal temple despite
court orders.The judges rejected a plea by advocate A Y Thackeray who appeared
for the trustees Shri Shwetambar Murti Poojak Tapogachh Jain Sang Pedhi. “We are
trying to get the temple legalised and an application is pending with the
Maharashtra government.” The BMC informed the court that the temple was
illegally constructed in 1998 and it had issued orders for demolition under
section 351. Bane said that the area where the temple was being constructed was
reserved for a recreational ground and a playground. The plot belonged to the
Jagdusha Nagar Plot Owners Association, an association of 40 buildings in the
area. Bane said that the trustees had illegally constructed the temple.
